If removal proceedings have started, your asylum application would be determined by an immigration judge.
Asylum and Refugee Status
If your application is granted, there is an additional benefit to asylum status or refugee status. You are able to file applications for your spouse and children to join you in the United States. After one year in asylum status, you are eligible for lawful permanent residence.
